1. Business Information

These Terms of Service govern the use of and purchases made through the TICBuddy website, a commercial brand operated by:

TICBuddy is an online technology store specialising in products including laptops, monitors, computers, accessories and other electronic equipment.

Products may be new, refurbished, pre-owned or professionally checked, as clearly stated on the relevant product page.

Orders are managed by LIRBATIC SL from Spain.


2. Acceptance of These Terms

By accessing or using this website or placing an order through TICBuddy, you agree to these Terms of Service together with our:

  • Privacy Policy

  • Return & Refund Policy

  • Cookie Policy

  • Shipping Policy, where applicable

Nothing in these Terms limits or excludes any mandatory consumer rights provided by applicable law.

If you do not agree with these Terms, you should not use the website or place an order.


3. Eligibility and Customer Accounts

You must have the legal capacity required to enter into a purchase contract.

Where an account is created, you are responsible for:

  • Providing accurate and up-to-date information.

  • Maintaining the confidentiality of your login credentials.

  • Keeping your contact and delivery information accurate.

  • Informing us if you suspect unauthorised use of your account.

You must not impersonate another person or use false or misleading information.

We may restrict or suspend an account where reasonably necessary due to suspected fraud, security concerns, unlawful activity or serious misuse of the website.


4. Products and Product Information

We make reasonable efforts to ensure that product descriptions, specifications, photographs and other information displayed on TICBuddy are accurate.

However, colours and appearance may vary slightly depending on:

  • Screen settings.

  • Lighting conditions.

  • Photography.

  • The individual condition of a refurbished or pre-owned unit.

Where a product is refurbished or pre-owned, it may display cosmetic signs of previous use consistent with the condition or grade stated on the product page.

Examples may include minor scratches, marks or signs of normal wear where these are compatible with the advertised condition.

Any material defects, limitations or relevant condition information known to us will be described where reasonably appropriate.


5. Technical Specifications

Technical information such as:

  • Processor

  • RAM

  • Storage capacity

  • Screen size

  • Resolution

  • Battery information

  • Ports

  • Operating system

  • Keyboard layout

  • Connectivity

  • Accessories included

will be specified on the relevant product page where applicable.

Customers should review the product specifications before placing an order.

If there is an inconsistency between general promotional material and the specific information shown on an individual product page, the information relating specifically to that product will normally take precedence, subject to applicable law.


6. Refurbished and Pre-Owned Equipment

TICBuddy may sell refurbished, pre-owned or professionally checked technology.

Unless otherwise stated on the product page, such products are not represented as factory-new devices.

Refurbished or pre-owned devices may have:

  • Previous usage history.

  • Minor cosmetic imperfections.

  • Battery capacity below that of a factory-new device.

  • Replacement or refurbished components where appropriate.

  • Packaging different from the original manufacturer's retail packaging.

The exact condition, configuration and relevant characteristics will be stated on the product page where applicable.

Normal characteristics that were clearly disclosed before purchase will not, by themselves, constitute a lack of conformity.

This does not affect your statutory rights if the product does not correspond to its description or applicable legal requirements.


7. Battery Condition

Rechargeable batteries are consumable components whose maximum capacity naturally decreases over time and through previous use.

For refurbished or pre-owned laptops and other battery-powered devices, battery health may therefore be lower than when the product was originally manufactured.

Where specific battery-health information or a minimum battery condition is advertised for a product, that information will form part of the product description.

A reduction in battery capacity that is consistent with the condition clearly disclosed before purchase does not automatically constitute a defect.

Nothing in this section limits your statutory rights where a battery or device fails to conform to the sales contract.


8. Orders

Placing an order through TICBuddy constitutes an offer to purchase the selected products under these Terms.

After an order is submitted, you may receive an automatic acknowledgement confirming that we have received the order.

An automated acknowledgement does not necessarily mean that the order has been finally accepted.

The purchase contract will be considered concluded once the order has been accepted and processed by us in accordance with the checkout and payment process.

We reserve the right to reject or cancel an order where reasonably necessary, including in cases involving:

  • Suspected fraud.

  • Unauthorised payment.

  • Manifest pricing errors.

  • Incorrect stock information.

  • Technical errors.

  • Legal or regulatory restrictions.

  • Incorrect or incomplete customer information that prevents fulfilment.

  • Abusive or automated purchasing activity.

If we cancel an order after payment has been collected, the corresponding amount will be refunded.


9. Product Availability

All orders are subject to product availability.

Although we make reasonable efforts to keep inventory information accurate, a product may occasionally become unavailable after an order has been placed.

If we cannot fulfil an order, we will inform the customer and refund any amount paid for the unavailable product.

We are not obliged to supply a substitute product unless expressly agreed with the customer.


10. Prices and Taxes

Unless otherwise indicated, prices displayed to consumers include applicable taxes in accordance with the tax rules applicable to the transaction.

Prices are normally displayed in euros (€), although other currencies may be displayed where supported by the store.

Shipping charges and any other applicable costs will be shown before the customer completes the purchase.

We may change prices at any time. Changes will not normally affect orders that have already been validly accepted, except where permitted by law in the case of a clear and obvious pricing error.


11. Pricing Errors

Despite our efforts to maintain accurate information, a product may occasionally be displayed with an incorrect price due to a technical, administrative or human error.

Where a pricing error is obvious and could reasonably have been recognised as an error, we may contact the customer and cancel the affected order where legally permitted.

If payment has already been collected for a cancelled order, the amount paid will be refunded.


12. Payments

Available payment methods will be shown during checkout.

Payments may be processed by Shopify or other third-party payment service providers.

By submitting payment information, you confirm that you are authorised to use the selected payment method.

We may carry out or rely on fraud-prevention and payment-verification procedures before accepting an order.

TICBuddy does not directly store complete payment-card details where they are processed by an authorised third-party payment provider.


13. Shipping and Delivery

Orders are prepared and dispatched from Spain unless otherwise stated.

Estimated delivery times displayed on the website or during checkout are estimates and may be affected by circumstances outside our reasonable control.

These may include:

  • Carrier delays.

  • Severe weather.

  • Public holidays.

  • Customs procedures where applicable.

  • Transport disruption.

  • Incorrect or incomplete delivery information supplied by the customer.

  • Events of force majeure.

We will take reasonable steps to fulfil orders within the applicable legal requirements.


14. Transfer of Risk

For consumer orders where TICBuddy arranges delivery, the risk of accidental loss or damage generally remains with us until the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods.

If the customer independently appoints a carrier that was not offered by TICBuddy, different rules regarding the transfer of risk may apply in accordance with applicable law.


15. Delivery Information

Customers are responsible for providing complete and accurate delivery information.

If an order cannot be delivered due to an incorrect or incomplete address provided by the customer, additional shipping costs may apply where legally permitted.

If a parcel is returned to TICBuddy following an unsuccessful delivery, we will contact the customer regarding the available options.

Nothing in this section affects rights available to consumers under applicable law.


16. Inspection on Delivery

We recommend inspecting the package and product as soon as reasonably possible after delivery.

If you receive a product that appears to be:

  • Damaged in transit.

  • Incorrect.

  • Missing essential components.

  • Significantly different from its description.

please contact us at admin@ticbuddy.com as soon as possible.

Providing photographs of the packaging and product may help us investigate transport damage or other issues more quickly.

Failure to report an issue immediately does not remove mandatory consumer rights provided by law.


17. Right of Withdrawal and Returns

Consumers purchasing online may have a statutory 14-day right of withdrawal.

Returns and refunds are governed by our Return & Refund Policy, which forms part of these Terms.

The right of withdrawal is separate from the customer's rights regarding defective or non-conforming products.

Please review our Return & Refund Policy before returning any product.


18. Legal Guarantee and Product Conformity

Products sold to consumers are covered by the statutory conformity and guarantee rights required by applicable consumer law.

Under Spanish consumer law, new goods are generally subject to a legal conformity period of three years from delivery.

For second-hand goods, the seller and consumer may agree to a shorter period where permitted by law, but such agreed period may not be less than one year from delivery.

Where TICBuddy applies a specific legally permitted guarantee period to a pre-owned or refurbished product, it will be clearly communicated to the customer before purchase.

Nothing in these Terms reduces any mandatory rights available to consumers under applicable law.


19. Remedies for Non-Conforming Products

If a product does not conform to the sales contract, the consumer may be entitled to remedies provided by applicable law.

Depending on the circumstances, these may include:

  • Repair.

  • Replacement.

  • Price reduction.

  • Termination of the contract and refund.

The appropriate remedy will depend on the circumstances and applicable consumer legislation.

20. Software, Operating Systems and Licences

Certain computers may be supplied with an operating system or other software.

Where applicable, software licences are subject to the terms imposed by the relevant software provider.

Customers must not use software supplied with a product in violation of applicable licence conditions or law.

TICBuddy does not guarantee continued support for third-party software beyond the obligations that apply to us as the seller.

Software updates, operating-system requirements and third-party service availability may change over time.


21. Customer Data on Devices

Customers are responsible for maintaining appropriate backups of their personal data.

Before returning a computer or storage-capable device, customers should remove personal information, sign out of accounts and disable activation locks where applicable.

Where reasonably necessary for diagnosis, repair, return processing or refurbishment, a device may need to be reset or erased.

22. Business Customers

Some provisions of consumer protection legislation, including the statutory right of withdrawal applicable to distance sales, apply specifically to consumers.

Where a purchase is made by a company, self-employed professional or other person acting primarily for business or professional purposes, certain consumer-specific rights may not apply.

Any separate business terms expressly agreed between TICBuddy and a business customer will take precedence where applicable.


23. Promotions and Discount Codes

Promotional offers, discount codes and special campaigns may be subject to additional conditions.

Unless otherwise stated:

  • Promotions cannot be exchanged for cash.

  • Discount codes may have an expiry date.

  • Codes may be limited to specific products or customers.

  • Multiple discounts may not be combinable.

  • A promotion may end when allocated stock is exhausted.

Any specific conditions shown with a promotion form part of that promotion.


24. Intellectual Property

Unless otherwise stated, the content of the TICBuddy website, including:

  • Text.

  • Graphics.

  • Branding.

  • Logos.

  • Website design.

  • Original photographs.

  • Videos.

  • Original written content.

is owned by or licensed to LIRBATIC SL and is protected by applicable intellectual-property laws.

Third-party trademarks, product names and logos remain the property of their respective owners.

You may not reproduce, distribute or commercially exploit protected TICBuddy content without prior authorisation, except where permitted by law.


25. User Reviews and Content

Where TICBuddy allows customers to submit reviews, photographs, comments or other content, the user remains responsible for the content submitted.

Users must not submit content that:

  • Is unlawful.

  • Is fraudulent or deliberately misleading.

  • Violates intellectual-property rights.

  • Contains malicious code.

  • Violates the privacy or rights of another person.

  • Contains illegal threats, harassment or other unlawful material.

Where legally permitted, you grant LIRBATIC SL a non-exclusive licence to display and use voluntarily submitted reviews or content in connection with TICBuddy and its commercial activities.

This does not transfer ownership of your content to LIRBATIC SL.


26. Prohibited Uses

You may not use the TICBuddy website:

  • For unlawful or fraudulent activity.

  • To impersonate another person.

  • To interfere with the security or operation of the website.

  • To introduce malware or malicious code.

  • To gain unauthorised access to systems or accounts.

  • To carry out abusive automated purchasing activity.

  • To scrape or systematically extract protected website content in violation of applicable law.

  • To misuse promotional systems or payment processes.

  • To violate the rights of TICBuddy, LIRBATIC SL or third parties.

We may take proportionate measures to protect the website and our customers where misuse is detected.


27. Third-Party Services

TICBuddy may rely on third-party providers for services including:

  • Payments.

  • Shipping.

  • Analytics.

  • Customer communications.

  • Fraud prevention.

Nothing in this section excludes responsibility that cannot legally be excluded by TICBuddy.


28. Shopify

The TICBuddy online store is hosted using Shopify, which provides the e-commerce infrastructure used to operate the website.

The sales contract for products purchased from TICBuddy is entered into with LIRBATIC SL, not Shopify.

Shopify may separately process information in connection with its platform in accordance with its own terms and privacy practices.

The website may contain links to third-party websites.

TICBuddy does not control those websites and is not responsible for their independent content, availability or privacy practices.

Customers should review the applicable terms and privacy information of any external website they choose to visit.


30. Website Availability

We aim to keep TICBuddy available and functioning correctly, but uninterrupted access cannot be guaranteed.

The website may occasionally be unavailable because of:

  • Maintenance.

  • Technical failures.

  • Security incidents.

  • Updates.

  • Events beyond our reasonable control.

We may modify or discontinue website features where reasonably necessary.

This does not affect existing contractual obligations relating to orders already accepted.


31. Errors and Corrections

The website may occasionally contain typographical errors, inaccurate information or omissions relating to matters such as:

  • Specifications.

  • Prices.

  • Shipping information.

We may correct such information when discovered.

Different limitations may apply to customers purchasing primarily for business purposes, subject to applicable law and any separately agreed business terms.


33. Force Majeure

TICBuddy will not be responsible for delays or failures caused by circumstances outside our reasonable control to the extent permitted by law.

Such circumstances may include:

  • Natural disasters.

  • Severe weather.

  • Transport disruption.

  • Strikes not limited to our own workforce.

  • Government measures.

  • Telecommunications failures.

  • Widespread technical disruption.

  • Other extraordinary events outside our reasonable control.

We will take reasonable steps to minimise the effects of such circumstances where possible.

We encourage customers to contact us first at admin@ticbuddy.com so that we can attempt to resolve any issue directly.

Any dispute will be subject to the courts having jurisdiction under applicable law.

Nothing in these Terms restricts any mandatory jurisdiction rights available to consumers, including rights that may allow consumers to bring proceedings before the courts of their place of residence where applicable.

We may update these Terms of Service from time to time to reflect:
